Wafir App – Terms & Conditions
1. Introduction & Ownership
Welcome to Wafir (“App”, “we”, “us”, “our”).
The Wafir App is owned and operated by W1 Foodstuff Company, a company duly registered and operating under the laws of the State of Kuwait.
Wafir is a digital marketplace specializing in offering near-expiry, best-before, or short-dated consumer goods at discounted prices.
By accessing or using the App, you agree to be bound by these Terms & Conditions.
2. Eligibility
- Users must be 18 years or older to place orders.
- By using the App, you confirm that all information provided is accurate and complete.
3. Nature of Products (Important Disclosure)
Wafir specializes in selling products that are:
- Near to their expiration date, or
- Past their “Best Before” date but still safe for consumption or use according to manufacturer guidance and applicable regulations.
By placing an order, the user explicitly acknowledges and accepts that:
- Products may have a short remaining shelf life
- “Best Before” dates are different from Expiration Dates
- Discounts are offered specifically due to reduced shelf life
Expiry or best-before information is clearly displayed in the App prior to checkout.
4. Product Safety & Compliance
- All products sold comply with Kuwaiti laws and regulations at the time of sale.
- Products that are legally prohibited from sale after expiry will not be sold.
- Responsibility for proper storage transfers to the customer upon delivery.
5. Pricing & Payments
- Prices reflect the product’s shelf life and condition.
- Discounts cannot be disputed after purchase.
- Payments must be completed using approved payment methods available in the App.
6. Delivery
- Delivery timelines are estimates and may vary. (2-3 hours)
- Risk of loss or damage transfers to the customer upon delivery.
7. Returns & Refund Policy
Wafir offers a 15-day return window, subject to the following conditions:
Eligible for Return:
- Incorrect item delivered
- Product damaged upon delivery
- Manufacturing defect not related to expiry or shelf life
Not Eligible for Return:
- Expired products after delivery
- Products past their best-before date at the time of purchase (clearly disclosed)
- Opened, used, or consumed products
- Improperly stored items
- Change-of-mind returns
⚠️ No returns or refunds will be accepted for products that expire after delivery, even if within the 15-day return period.
8. User Responsibility
The user is responsible for:
- Reviewing product expiry or best-before dates before purchasing
- Using products before expiration
- Proper storage after delivery
9. Limitation of Liability
W1 Foodstuff Company and Wafir shall not be liable for:
- Misuse or improper storage of products
- Use or consumption beyond expiration dates
- Indirect, incidental, or consequential damages
10. Account Suspension
We reserve the right to suspend or terminate user accounts in cases of:
- Abuse of the return or refund policy
- Fraudulent activity
- Violation of these Terms & Conditions
11. Amendments
Wafir reserves the right to update or modify these Terms at any time. Continued use of the App constitutes acceptance of the updated Terms.
12. Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the State of Kuwait.
